Terms and Conditions of Use
- PREAMBLE
You are visiting the website of L’hôtel La Frégate – Entreprise Miléade (hereinafter “the Site “) published by the company Miléade (“Miléade“). The purpose of these general terms and conditions (the “Terms of Use“) is to define the terms and conditions of use of the Site and the rights and obligations applicable to any Internet user visiting it (the “User“). .. If the User uses the online booking service on the Site, he or she must read the general terms and conditions of sale. Access to and use of this Site is subject to the following conditions and the legal provisions in force.
- ENTRY INTO FORCE AND ENFORCEABILITY OF THE T&CS
These T&Cs come into force on the date they are posted online. Consulting the Site implies that the User has read these T&Cs, that he accepts them and undertakes to comply with them.
They are enforceable against the User from his first visit to the Site, and this, throughout the duration of use of the Site and until new T&Cs are published, if necessary.
The User may at any time renounce the use of the Site but remains responsible for any previous use.
- TECHNICAL REQUIREMENTS

However, Miléade cannot guarantee absolute accessibility or availability of the Site.
Miléade reserves the right to interrupt or suspend, temporarily or permanently, all or part of the Site and/or its functionalities at any time and without notice, in particular i) to carry out an update, maintenance operations, modifications or changes to its infrastructure, or ii) in the event of non-compliance by the User with the T&Cs, in particular if the User compromises or attempts to compromise the security or integrity of the Site.
Miléade cannot be held responsible for any unavailability of the Site, whether voluntary or not. Similarly, Miléade cannot be held liable for any damage caused to the operating system and the functionalities of the equipment used due to interruptions or disruptions of the Site.
- DESCRIPTION DU SITE
The Site and all of the features it offers to Users (the “Services“) are offered in French and English. It provides access to information about Miléade’s activities. This information is provided for informational purposes only and is subject to change.
Miléade makes every effort to check the veracity of the information and to keep the Site up to date. However, no guarantee is given regarding the accuracy, precision, updating or completeness of the information made available on the Site. Any use in the form of reproduction, modification, computer loading, distortion, transmission or distribution, in whole or in part, of all or part of the Site is subject to the prior written authorization of Miléade, with the exception of a copy for private and non-commercial use and subject to compliance with intellectual property rights and any other property rights mentioned. The following mention must appear on all copies of all or part of the content of the Site: “Copyright Miléade”.
Any unauthorised use of the Website or its content would engage the responsibility of the User and would constitute an infringement punishable by articles L. 335-2 et seq. of the Intellectual Property Code. Any link or framing of the Site is therefore strictly forbidden and consequently, no element appearing on a page of the Site may be partially or totally distributed, transferred or inserted on another site, except with the express authorization of Miléade.
Miléade grants the User a simple right to use the Site. This right is revocable, free, non-exclusive and worldwide. It is intended for personal use under the conditions hereof.
- THIRD-PARTY SITES AND HYPERTEXT LINKS
Links set up by Miléade. In order to facilitate access to other sites likely to provide additional information, Miléade has inserted a number of hypertext links on the Site giving access to pages of websites other than those of the Site. Nevertheless, Miléade cannot be held liable for the content of the information provided on these third-party sites, its unavailability and/or any other elements available on these third-party sites to which the User may have access via the Site. Miléade has no means of controlling the content of these third-party sites.
Links set up by the User. The setting up of a link pointing to the Site implies obtaining the prior written consent of Miléade, it being specified that such authorization cannot be qualified as affiliation. Miléade declines all responsibility for the content of the information provided on any site to which a redirection to the Site is made or for the activation of hypertext links posted by the User.
- SECURITY
Miléade makes its best efforts, in accordance with the rules of the art, to provide a quality Site and to secure the Site in view of the complexity of mobile networks and the Internet.
The User takes all appropriate measures to protect his or her own data and/or software from contamination by possible viruses and malware.
The User shall refrain from carrying out or attempting to carry out any operation or action aimed in particular at saturating a page, the servers, generating denial-of-service attacks (DDOS), or any operation that has the consequence of hindering or distorting the operation of the Site or that would impose a disproportionate load on the Site’s infrastructure.
The User undertakes to consider that all data, documents or information of which he/she has become aware during such access to an unauthorised space are confidential data and undertakes, consequently, not to disclose them or make them available to third parties.

- OBLIGATIONS OF THE USER
The User is responsible for his or her use of the Site. The User undertakes:
- not to disrupt the proper functioning of the Site, and in particular not to introduce viruses, malicious code or any other technology that is harmful to the Site;
- to use the Site fairly, in compliance with these T&Cs, applicable laws and regulations, in particular laws relating to the protection of personal data and intellectual and industrial property, and IT;
- not to develop or use software, devices, robots or any other means or technology aimed at scraping the Site or disrupting its use;
- not to access or remain, fraudulently, in all or part of the Site and to use a method of access other than the interface made available by the Site, it being recalled that any fraudulent access or maintenance in the Site is punishable under criminal law as well as any hindrance or alteration of the operation of the Site or its infrastructure, or in the event of introduction, deletion or modification of the data or information contained therein;
- not to breach or circumvent the security measures put in place, in particular to protect the Site or the servers on which it is hosted.
In addition, the User shall refrain from any misuse of the personal information present on the Site, and from collecting information on other Users in any way whatsoever, manually or automatically, without their consent, in particular with a view to sending unsolicited prospecting or spam.
- PROTECTION OF PERSONAL DATA
The processing of personal data implemented by Miléade in the context of the use of the Site complies with the French Data Protection Act No. 78-17 of 6 January 1978 and the French Data Protection Act in force, and Regulation (EU) 2016/679 on the protection of natural persons with regard to personal data of 27 April 2016, as well as any other applicable regulations on the protection of personal data.

- PROMOTIONS
Miléade offers promotions on the Site. These operations are governed by special provisions accessible on the web pages dedicated to them.
- RESPONSIBILITY
RESPONSIBILITY OF MILÉADE. Miléade cannot be held responsible for:
- the quality of the Services, which are offered “as is”, errors or omissions published on the Site,
- direct or indirect damage, which may result from i) access to or use of the Site, including accessibility, loss of data, deterioration, destruction or viruses, which may affect the User’s equipment and/or the presence of viruses on this Site, or ii) the information contained therein,
- any damage or virus that could damage or render unusable their computer equipment following a visit to the Site.
USER RESPONSIBILITY. The User undertakes not to disturb the use that other Users may make of the Site, and not to access parts of the Site to which access is reserved.
Any use of the Site contrary to these Terms and Conditions entitles Miléade, after having notified the User, to prohibit the User from accessing all or part of the Site, without prejudice to any damages to which Miléade may be entitled and the remedies that may be offered to him.
The User guarantees Miléade against any action, claim, claim or opposition, whatever its form, purpose or nature, by any person invoking in particular an intellectual property right and/or an act of unfair and/or parasitic competition and/or an invasion of privacy and/or any other breach of the applicable legal and regulatory provisions, and which would be related, directly or indirectly, to its use of the Site.
In this case, the User shall indemnify Miléade for all consequences resulting from the implementation of the above guarantee and in particular the costs of any kind, incurred by Miléade to ensure its defence, including the costs of advice or proceedings, as well as all damages, costs and sums due under Article 700 of the Code of Civil Procedure that may be pronounced against it.
- JUDICIAL REQUISITIONS
The User is informed that his/her identification/connection data may be communicated by Miléade to third parties under the conditions provided for by applicable law. In general, Miléade reserves the right to access, read, preserve and disclose any information necessary to satisfy any legal process or administrative request.
- GENERAL PROVISIONS
NULLITY. If one or more provisions of these Terms and Conditions are held to be invalid or declared as such pursuant to a law, regulation or following a decision that has become final by a competent court, the other provisions shall retain their full force and scope.
MODIFICATIONS. Miléade reserves the right to make any changes and improvements to the T&Cs deemed useful or necessary, and in particular to take into account any technical, legislative, regulatory or security-related changes or the proper functioning of the Site. Any use of the Site by the User after modifications to the T&Cs implies acceptance by the User of the new version of the T&Cs.
APPLICABLE LAW – COMPETENT JURISDICTIONS. These T&Cs are governed by French law. In the event of a dispute, the User must first send a complaint to Miléade, at the address relationclient@mileade.com in order to find an amicable solution. In the absence of an amicable solution materialized by the conclusion of a memorandum of understanding within 30 days of the sending of a complaint referring to this provision, any dispute will be within the jurisdiction of the competent courts in France.
